Conditions and Terms of Sales
Article 1 : Booking
Anyone wishing to stay at the villa is advised to book in advance. Reservations will only be confirmed once you have received confirmation from us. A deposit or credit card number (on online booking platforms) is required for all bookings. The hotel contract is deemed to have been concluded as soon as the parties have reached an agreement. In the event of credit card rejection or error, the villa may cancel the reservation. The villa reserves the right to pre-authorize the credit card before the arrival date.
Article 2 : Payment
Accommodation is payable on the day of departure at the latest. For long-term rentals (1 week or more), bills must be paid weekly. We accept the following credit cards: Visa, Mastercard. It is also possible to pay in cash or by mobile banking mvola and orange money. Please note that bank charges for card payments and withdrawal fees for mobile banking payments are payable by the customer and will be added to the amount to be paid. The applicable rates can be consulted at the villa. In application of article 2102 of the Civil Code, the customer cannot oppose the retention of his luggage if he refuses to pay.
Payment for the stay and other services may be made in foreign currency, the rate of which is fixed in advance by the villa and displayed in the office. The applicable rate is that in force on the day of payment, whether for the deposit or the balance. It is based on the rate charged by foreign exchange bureaux and differs from the rate posted by the central bank. To avoid exchange risks or any other differences, the customer is invited to pay in local currency. Payment by foreign bank card will always be made in local currency.
Room rates are per day. Failure to pay will result in the immediate expulsion of the customer, subject to legal proceedings for payment of the amount due. In the event of dispute, jurisdiction will be attributed to Mr. Juge des référés of the Civil Court of Nosy Be.
Article 3 : Reservation cancellation / modification and commitment
In the event of cancellation of your booking, you will be entitled to a refund of your deposit, less transfer charges (by mobile banking or bank transfer) and penalties as defined below:
• Up to 7 days before arrival: without penalty
• From 6 to 2 days before arrival: 50% of the total deposit
• From 1 day before arrival to no show or early departure: 100% of the total deposit.
We reserve the right to re-let a room without delay under the following conditions :
• Cancellation by the customer.
• Modification of the reservation by the customer.
• No-show by the customer.
Article 4 : Access to rooms, departure and arrival
All guests wishing to stay at the villa must identify themselves and any accompanying persons. For this purpose, they will be asked to complete and sign a police form.
Check-in (access to the room) takes place from midday onwards, unless otherwise agreed by the villa. The room must be vacated by 11 a.m. on the day of departure at the latest, regardless of the arrival time of the customer, unless otherwise agreed by the villa. Occupation of the room beyond this time until 6pm is possible for an additional charge of 50% of the room rental. After 6 p.m. 100% of the room rental will be charged to the customer. Guests may wait in the common areas beyond check-out time at no extra charge. They can also leave their luggage at the villa office until their departure.
On departure, guests must hand in their room key. In the event of loss or non-return of the key at the end of the stay, the customer will be charged MGA 50,000 per copy.
Guests are strictly forbidden to take any object belonging to the villa with them: they must inform the staff if they notice any mistake and return it, otherwise they will be billed.
Article 5 : Children and extra beds
A crib is provided free of charge for children under 3 years of age at the customer’s request. Children may stay free of charge with their parents if they share the parental bed.
An extra bed is available for rooms that can accommodate an extra bed, at a supplement of 50,000MGA per night.
Article 6 : Pets
Pets and guide dogs are allowed in the villa free of charge with the prior agreement of the villa. However, owners must ensure that their pets do not disturb the peace and quiet of other guests.
Pets are the responsibility of the tenant. It is forbidden to leave it unattended in the room. Any damage caused intentionally or unintentionally must be paid for by the tenant.
Article 7 : Included services
Room rental includes daily cleaning of rooms and common areas, supply of hygiene products (soap and toilet paper) and change of linen.
Unless otherwise specified, it does not include, but is not limited to, excursions, transport services, catering, dishwashing and laundry. These services can be provided by the villa at extra cost. Please ask the staff for details.
If the guest offer is a bed and breakfast, this concerns a simple breakfast or a Malagasy-style breakfast. Guests may request supplements, which will be charged according to the menu.
If the customer subscribes to the chef + waitress service, please note that the rate shown is per service. Service is limited to 4 hours, including preparation, service and dishwashing, and may not exceed 10pm to ensure the safety of our teams. The purchase and supply of ingredients is the responsibility of the customer; it may be entrusted to the team but will be included in the 4-hour service mentioned above, and the amount of shopping and travel expenses must be provided by the customer in advance. Please note that food prices in Nosy Be are different from those in the capital or other towns in Madagascar, due to the remoteness of the area. Only supermarket purchases are accompanied by a receipt or proof of purchase. Any changes to the above conditions must be discussed with the villa’s management, and may result in additional charges depending on the services requested.
Article 8 : Degradation
The customer must use the rented property with due care.
The rooms made available to our customers are checked, functional and in good condition. Customers are asked to report any deficiencies immediately to the villa reception.
In the event of a problem, the customer will be held responsible. In the event of damage, the villa reserves the right to invoice the customer for the cost of repair or replacement, the rates for which are provided in the room directory and/or in the list of equipment supplied. The same applies to any infringement found after the customer’s departure, the amount of compensation will be debited from the customer’s credit card.
In the event of flooding or water damage, whether voluntary or involuntary, the villa may demand full reimbursement of the damage caused. In the event of damage to other rooms, reimbursement will be demanded for the nights of other guests.
The villa may charge a cleaning fee if the room is left in a condition deemed unsuitable. In the event of damage to carpets, bedding or bedsprings, the villa will demand reimbursement of the damage, with a minimum charge of €1,000 for repairs and for not being able to re-let the rooms.
As a general rule, customers must pay any damage caused directly to the villa. They can call on their insurance (if they wish to be reimbursed) for any voluntary or involuntary damage they cause during their stay.
Article 9 : Peacefulness and respect for other guests
The Villa prohibits the use of drugs and sex tourism, particularly child prostitution.
Access by outsiders not staying at the villa is subject to prior authorization by the villa manager. The villa manager reserves the right to charge a supplement if such persons use the villa’s facilities. Except for full villa rentals and/or with prior authorization from the villa, outsiders must leave the villa by 9pm at the latest to respect the peace and quiet of the other tenants and owners of the residence. However, events in the villa (especially for full villas), unless otherwise agreed, must avoid any noise from midnight onwards, to avoid any inconvenience to neighbors.
In the event of failure to comply with the above, the customer will be asked to leave the villa without being able to demand any refund, and will be required to pay the entire bill.
Article 10 : Complaints
Any complaint concerning the quality of the services provided must be presented to the villa manager immediately.
Article 11 : Mini safe
Identity papers and valuables (watches, jewelry, means of payment, etc.) must be placed in the mini safe provided. For larger items, a safe is available at reception.
Article 12 : Forgotten belongings
The villa cannot be held responsible for forgotten items.
Should you forget your belongings, please notify the villa manager as soon as possible. If the customer requests the return of his/her belongings by parcel or courier, this must be done with tracking and insurance for valuable items. The shipment will be made after the customer has paid the shipping costs.
Article 13 : Acceptance of general sales conditions
The villa reserves the right to update its terms and conditions of sale and will inform its customers either by publication on its website or by e-mail.
Any reservation of a room by a customer implies acceptance of the present general terms and conditions of sale. Failure to comply with the above provisions will result in immediate termination of the contract. In the event of non-acceptance of all or part of the articles of the general terms and conditions, the customer must notify us before accessing the room. Termination of the contract for non-acceptance of the general sales conditions must comply with the terms of article 3.
Article 14 : Disputes
In the event of a dispute between the professional and the consumer, the latter shall endeavor to find an amicable solution. Failing amicable settlement, the commercial court of Nosy Be shall have sole jurisdiction.
